New York reinsurance: admitted versus surplus lines, NYDFS flavour, NAIC paperwork
New York is an admitted-versus-surplus-lines problem as much as a placement problem. NYDFS and NAIC filings flavour the paperwork; this page does not invent a Reinsured.AI producer licence. The ops work is keeping the affidavit, the form, and the reinsurance bordereau from becoming three stories about the same ACME risk.
New York's distinctive argument is not "another global hub with better restaurants." It is whether the risk sat on admitted paper, surplus lines paper, or a reinsurance contract that someone later treated as if it were a policy. The New York Department of Financial Services supervises insurers and producers in the state. NAIC blanks and model laws flavour how groups report reinsurance, credit, and collateral across the US. This page uses that flavour. It does not invent a NYDFS licence, a surplus lines broker number, or an NAIC company code for Reinsured.AI.
Placement customs follow that split. An admitted carrier writing New York contractors uses forms and rates inside a licensed system. A surplus lines placement for the same tower — because occupancy, limit, or catastrophe appetite sat outside admitted markets — needs a surplus lines licensee, often a diligent-search record, and a stamping or filing trail that varies by state. Reinsurance sitting behind either is a separate contract. If the facultative certificate names a different named insured than the surplus lines policy, recoveries will be argued in two buildings. The brokers hub is the placing-file view. Facultative reinsurance is the optional-risk view. This page is the New York-market view: admitted versus E&S, and the documents that prove which one you actually bound.

Admitted paper versus surplus lines
Admitted is not a synonym for "good." Surplus lines is not a synonym for "unregulated." Admitted means the carrier is licensed in the state for that line and the form path is the admitted path. Surplus lines means the risk was exported to a non-admitted market through a licensed surplus lines broker, with the state's surplus lines rules attached. Construction in Manhattan hits both. A builders-risk or general-liability placement can start admitted and move E&S when the TIV, the crane, or the flood zone falls outside guidance.
Ops failures are ordinary and expensive.
The policy jacket is admitted ISO language. The binder email describes a manuscript E&S deductible. Accounts book the email. The surplus lines affidavit names ACME Construction LLC. The reinsurance slip names ACME Construction Ltd. Someone "cleans" the name in the admin system. The treaty reinsurance bordereau later includes the same ACME as if it were automatic cession. It was facultative leftover. Two contracts, two files.
Stamping-office and diligent-search artefacts are documents. They are not a vibe that the broker "did the search." If those PDFs are missing from the pack, the chase list should say so. Software should not invent a search date to make a completeness ring look green.
NAIC flavour without invented licences
US groups file NAIC annual statements. Reinsurance credit, unauthorized reinsurers, and collateral show up in schedules and interrogatories. New York can be stricter than a model law in ways your counsel already knows. This page will not recap credit-for-reinsurance as if it were a product feature. The ops point is narrower: the counterparty, the collateral trust, the letter of credit, and the share must be extractable from the documents you actually hold.
If Schedule F will later list a Bermuda Class 4 as unauthorized or certified, the facultative certificate and the collateral agreement have to be in the pack with spans. A chat summary that says "fully collateralized" without the trust deed page is not a field an examiner will accept. Reinsurance AI is the operations map: every field a span, or a gap.
Casualty in New York adds long-tail loss runs, as-at dates, and claims-made versus occurrence fights. Documents a New York desk actually moves
Typical files:
- Binders, policy jackets, and endorsements — admitted form or surplus lines manuscript
- Surplus lines affidavits, stamping receipts, and diligent-search records where the state path requires them
- SOVs for New York City and tri-state locations, with flood and wind as fields, not as a covering-email adjective
- Loss runs with as-at dates; undated runs are chase items
- Facultative slips and certificates, often in USD
- Treaty wordings and bordereaux when the New York cedent cedes a book, not a building
- Collateral agreements, trust statements, and LOC exhibits when reinsurance credit depends on them
- NAIC or NYDFS exhibits as documents to extract from, not as filings we submit for you
Events still matter when the same New York broker flies to Monte Carlo for 1/1. The New York surplus-lines file does not become a London MRC because someone packed it in the same suitcase.
ACME Construction Ltd on William Street paperwork
Walk a fictional file. ACME Construction Ltd, domain acme.example, is building a Hudson Yards tower. The admitted GL market declined the crane and the flood. A surplus lines broker places a manuscript CGL and excess tower. The affidavit uses ACME Construction LLC, New York. The facultative reinsurance slip, shown to a Bermuda and a London following market, uses ACME Construction Ltd, interest "construction all risks," limit USD 25,000,000 xs USD 25,000,000. The SOV includes a Brooklyn staging yard that is not on the slip. The loss run is dated eighteen months ago.
That is not one risk. That is a name conflict, an interest conflict, a location conflict, and a stale loss history. A New York underwriter who prices a single TIV has guessed. The pack should show four gaps and the two legal names. Do not average Brooklyn into Hudson Yards.
